How does probate work?

My fiance and I bought a home together he died suddenly and I know we had insurance to cover the mortgage there was a disability death clause on it .. but it was never in my name the aggreement was that ( his children would inherit the lake cabin) and I would keep the house if anything would happen to him and if anything happened to me he would stay in the house .. now they are saying that it isn’t paid for and I know it is they are wanting to sell it and want me to move in 30 days..This is in Minnesota.. does any know anything on how I can find out if the house is paid for if they wont give me that information .. the morgatge company wont give me any info because I am not the exectour of the estate Thank you for any help you can give me I can prove that I paid the house payment out of my account .. can they evict me ? Probate is the process of going to court, having the will certified by a judge and having the executor named in the will certified as trustee of the estate.

You need to see a lawyer if you paid your own money into the house because you are in a grey area.

If your name does not appear on the title of the house or the mortgage, it becomes part of the estate. Unless the house is specifically willed to you and there is sufficient money to cover the mortgage or you agree to assume the debt (and the bank agrees to this), the trustee/executor have the right to sell the house to raise cash or pay the mortgage.
